Promoter/Sponsor of this Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes is Pacers ESports, LLC d/b/a Pacers Gaming (“Pacers Gaming”), with an address of 125 S. Pennsylvania Street, Indianapolis, IN, 46204 and Co-Sponsor is Qdoba Restaurant Corporation (“Qdoba”), with an address of 350 Camino De La Reina, Suite 400, San Diego, CA 92108. All entrants agree to be bound by the terms and conditions provided in these Official Rules as well as by all interpretations of these Official Rules by Pacers Gaming and by all other decisions of Pacers Gaming, including resolution of disputes in connection with this sweepstakes, which are final and binding in all matters relating to the Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes.

ELIGIBILITY
The Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes is open to legal residents of Indiana who are 18 years of age or older at the time of entry. Employees and immediate families of employees (spouse, parents, siblings, and children) of Qdoba, Pacers Gaming, the NBA 2K League, and each of their respective parents, subsidiaries, affiliates and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, members, employees and agents are not able to enter or win.
ENTRY PERIOD
The Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes begins on Friday, August 12, 2022 at 12:00 PM Indianapolis time and ends on Wednesday, August 17, 2022 at 11:59 PM Indianapolis time (the “Entry Period”).
HOW TO ENTER
Entrant must have a non-private Twitter account to participate in and enter this sweepstakes. If an entrant does not have a non-private account, there is no cost to create one at www.twitter.com. Entrant must agree to comply with the Twitter Terms of Service (https://twitter.com/tos) and Twitter Privacy Policy (https://twitter.com/privacy) in order to create a Twitter account. To enter, during the Entry Period, entrants must (i) follow @PacersGaming and @Qdoba on Twitter by going to https://twitter.com/PacersGaming and clicking the “follow” button and https://twitter.com/Qdoba and clicking the “follow” button; (ii) retweet the designated Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes tweet from the @PacersGaming Twitter account; and (iii) in your retweet described in part (ii), include a comment with your favorite Qdoba meal and include the hashtag #PacersGamingSweepstakes. Limit one (1) entry per person. Multiple entries per person, including multiple entries by the same entrant using different e-mail addresses and/or accounts, will invalidate ALL entries submitted by that entrant for the entire Entry Period. All entries must be received by Pacers Gaming by August 17, 2022 at 11:59 PM Indianapolis time.
Due to the way Twitter operates its service, Pacers Gaming may not receive entries from Twitter users with “protected” updates. Entrants must continue to follow @PacersGaming and @QDOBA through the Entry Period and for at least fourteen (14) days thereafter (for potential notification purposes) to participate in the sweepstakes and be eligible to win. The tweet must NOT, in the sole discretion of Pacers Gaming, (i) contain language that violates or infringes upon another’s rights, including but not limited to privacy, publicity or intellectual property rights (including, without limitation, trademark or copyright infringement); (ii) contain language that is inappropriate, indecent, obscene, profane, hateful, tortious, defamatory, slanderous, controversial or libelous; (iii) contain language that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; or (iv) contain language that is unlawful, in violation of or contrary to applicable laws or regulations.
WINNER SELECTION
One (1) winner will be selected randomly on or about August 17, 2022 from among all eligible entries received. Winner will be contacted by a Pacers Gaming representative by Twitter direct message on or about August 17, 2022. In the event the winner cannot be contacted within 72 hours of the initial email or phone notification or declines the prize another winner will be randomly selected from the eligible entries received.
It is the sole responsibility of the entrant to notify the Pacers Gaming if his or her contact information and/or e-mail address changes. To do so, send an e-mail to gweigel@pacers.com with the new contact information. Pacers Gaming and the NBA 2K League and each of their respective parents, subsidiaries, franchisees, affiliates, directors, officers, owners, shareholders, members, employees sponsors, licensees, successors, assigns and agents are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of Pacers Gaming and will not be returned.
Winners may be required to sign an Affidavit of Eligibility and Release attesting to the fact that he/she is 18 years of age or older, as well as other terms and conditions as designated by Pacers Gaming and consent to the use of his/her likeness in order to collect a prize.
PRIZE DESCRIPTION
The prize winner will receive two (2) tickets to the Friday, August 19, 2022 and Saturday, August 20, 2022 sessions of the 2022 NBA2KL 3v3 Playoffs and Finals held at The Pavilion at Pan Am in Indianapolis, Indiana ($15 per ticket per day value; $60 total value), one (1) night standard double-occupancy hotel accommodations at a hotel selected by Pacers Gaming (in its sole discretion) for the night of August 19, 2022 (meals, telephone calls, tips and other incidentals and costs are not included) ($300 value), Pacers Gaming merchandise including a Pacers Gaming t-shirt ($30 value), Pacers Gaming hat ($23 value) and Pacers Gaming beverage koozie ($4 value), and two (2) $10 Qdoba meal cards ($10/card value; $20 total value). Total retail value of prize is $437.
The winning prize is non-transferable to any other person, including relatives or friends. The name of the winner can be obtained by writing “Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes” c/o Pacers Gaming, 125 S. Pennsylvania Street, Indianapolis, IN, 46204.
Prize winner and his/her guest must agree to comply with all NBA 2K League and venue rules and regulations (as well as any applicable event-specific rules and regulations), including but not limited to any public health restrictions, relating to the use of event tickets for attendance at NBA 2K League games, events and/or other activities (as applicable) and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of prize or prize element. Winner and his/her guest are also responsible for understanding and complying with any protocols related to COVID-19.
If winner’s guest is under 18 years old, the winner must be the guest’s parent or legal guardian. Minors must be accompanied at all times (including, but not limited, hotel stay and all prize-related events) by minor’s parent or legal guardian. All expenses not specifically mentioned herein are not included and are solely the prize winner’s responsibility. Hotel regulations and conditions apply.
An inherent risk of exposure to COVID-19 exists in any public place where people gather. By accepting the prize, the winner and his/her guest voluntarily assumes all risks related in any way to exposure to COVID-19, and any other communicable or infectious disease or illness.
TAXES
The prize winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the sweepstakes, unless otherwise indicated. No substitution, cash equivalent or transfer of prize permitted except at Pacers Gaming’s option for a prize of comparable or greater value. All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to, meals, transportation, merchandise, parking, tips and gratuities.

RELEASE OF LIABILITY AND INDEMNIFICATION
By entering, each entrant agrees to follow the Qdoba x Pacers Gaming 2K Tournament Trip Sweepstakes Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against Twitter, Qdoba, Pacers Gaming, and/or the NBA 2K League and each of their respective parents, subsidiaries, franchisees, affiliates and related entities, as well as each of the aforementioned parties’ respective directors, officers, owners, shareholders, members, employees, representatives, successors, assigns and agents (collectively, the “Released Parties”), with respect to or arising out of either (i) entrant’s participation in the sweepstakes; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizing) awarded in the sweepstakes. Pacers Gaming reserves the right to cancel, modify or suspend the sweepstakes and/or change dates or prizes (to a prize of equal or greater value) relating to the promotion in case of schedule changes, acts of God, force majeure events, computer viruses, bugs, corruption or unfairness of the security or administration of the sweepstakes, or for any other reason at the sole discretion of the Pacers Gaming.
